Title IX Claims Against a NC University Dismissed
Our attorneys obtained dismissal of a Title IX claim against a North Carolina university. Plaintiff alleged that he was suspended in violation of Title IX and without due process after he was found guilty of sexual misconduct by a disciplinary panel. Our attorneys filed a motion to dismiss for failure to state a claim on the grounds that plaintiff could not establish gender discrimination under Title IX and could not establish a viable due process claim. The motion was granted, resolving the case in our client’s favor.
