Fourth Circuit Affirms Dismissal of College Student’s Title IX Claim

The Fourth Circuit affirmed the Western District of North Carolina’s dismissal of a college student’s Title IX claim.  Plaintiff alleged that she was subjected to sex-based harassment by fellow students, though the district court found that the college “took timely measures to end the harassment once they were aware of it,” and that the alleged actions were “not sufficiently severe or pervasive to create a hostile or abusive environment.”  The Fourth Circuit also affirmed the district court’s denial of Plaintiff’s effort to add a claim against the college under the ADA, finding that there was insufficient information regarding the student’s request of a specific accommodation.  Katie Weaver Hartzog represented the college before both the district court and the Fourth Circuit.
